In a compelling interview on GHANA WONSOM, the popular morning show on Ideal FM 96.7, hosted by B.I.C Abeiku Okai, renowned lawyer Mary Ohenewaa Afful weighed in on a distressing case of medical negligence that recently made headlines. The discussion, conducted over a phone call, centered around the shocking experiences of Mabel Mensah, a patient who suffered severe consequences due to improper medical care at Juaben Hospital.

Abeiku Okai opened the conversation with a critical question: “Do we get the treatment we expect when we visit the hospital? If not, what can be done? Is there a law that should be implemented to ensure we receive the care we deserve?” These questions set the stage for a deeper examination of the state of healthcare in Ghana and the legal ramifications of medical negligence.

The case in question involved Mabel Mensah, who had been pregnant for over nine months. During her visit to Juaben Hospital, doctors informed her that there were only two options available to ensure a safe delivery: either undergo a Cesarean section or take medication designed to ease the delivery process. The medication was prescribed to be taken in halves every four hours. However, despite following the instructions, there were no signs of labor. A nurse then advised Mabel to take a full tablet. Shortly after doing so, she finally delivered but began to experience severe bleeding.

This unfortunate series of events led Mabel to seek justice in the Kumasi High Court, where she was awarded a sum of GHC 4.3 million in compensation. Lawyer Mary Ohenewaa Afful, who has been closely following the case, provided crucial insights during the interview. She emphasized that such incidents are clear examples of medical negligence, where healthcare professionals fail to apply their knowledge and skills effectively, leading to harm.

“Doctors and nurses must use their expertise practically to avoid such tragic mistakes,” Lawyer Ohenewaa Afful stated firmly. She also called for legal action against the doctor responsible for Mabel’s ordeal, stressing that medical negligence is a serious issue that must be addressed to prevent future occurrences.

In addition to discussing the case, Lawyer Ohenewaa Afful highlighted the broader implications of inadequate legal knowledge among the public. “Lack of awareness of basic laws leads to unnecessary suffering,” she remarked, sharing another example of a man who was prescribed incorrect medication for two years, further underscoring the gravity of the situation.

The discussion also touched on the Domestic Violence Act 732, which ensures that victims of domestic violence have access to free healthcare. Lawyer Ohenewaa urged individuals who have been mistreated to seek the medical care they need without hesitation.
