Accra High Court Rejects Democracy Hub’s Injunction Request Against Baba Jamal
The Accra High Court has dismissed an application by the advocacy group Democracy Hub, which sought to block the Electoral Commission from accepting Baba Jamal, the National Democratic Congress (NDC) parliamentary candidate for the Ayawaso East by-election. The group had raised concerns of vote-buying during the party’s primary on February 7.
Democracy Hub had sought an injunction to prevent Baba Jamal’s candidacy unless the NDC conducted a fresh primary election. In response, the NDC’s legal team argued that the lawsuit was flawed and lacked merit.
The NDC’s lawyers argued that the matter was outside the jurisdiction of the High Court, referring to constitutional provisions that limit certain legal issues to the Supreme Court. They further emphasized that the procedural steps taken by Democracy Hub were incorrect and that the group did not have the legal standing to bring the case.
On Monday, March 2, Justice Agyenim Boateng ruled, rejecting the first and third grounds raised by the respondents but agreeing with the NDC’s argument that the process followed by Democracy Hub was procedurally deficient.
While dismissing the case, Justice Boateng acknowledged Democracy Hub’s advocacy efforts, recognizing the ongoing issue of vote-buying in Ghana’s electoral process. Despite the ruling, the court’s decision clears the way for the Ayawaso East by-election to proceed as planned on Tuesday.
