Court of Appeal Rules in Favor of Fetteh Kakraba Traditional Leaders in Land Dispute
A case filed by the Traditional Leaders of Gomoa Fetteh against the people of Fetteh Kakraba in the Central Region over allegations of being landguards has been settled by the Accra Court of Appeal. The Winneba High Court had previously granted a restraining order against the people of Gomoa Fetteh, preventing them from accessing the land.
However, the people of Gomoa Fetteh filed an appeal to reverse the ruling, claiming that the allegations of being landguards were unsubstantiated. The three-member panel chaired by Justice Philip Bright Mensah ruled in their favor, stating that the allegations were baseless, but ownership of the land remained with Fetteh Kakraba.
Following the ruling, the people of Gomoa Fetteh claimed victory and ownership of the Fetteh Kakraba lands. However, the lawyer for Fetteh Kakraba, Roland Atta kesse Hamilton, clarified that the ruling did not address the issue of ownership, but rather focused on the allegations of landguard activity and the restraining order.
He further noted that Fetteh Kakraba held three judgments from the Swedru, Cape Coast, and Winneba High Courts, which remained unchallenged. The Court of Appeal’s ruling upheld the restraining order against the people of Gomoa Fetteh, while affirming Fetteh Kakraba’s ownership of the land.
